AI and data privacy: what business owners need to understand

When you type a customer's name into an AI tool, where does that data go? When you upload a financial report to get a summary, who can see it? When you feed your internal documents into a chatbot, what happens to that information?

If you cannot answer those questions for every AI tool your business uses, you have a data privacy problem. And you are not alone. According to Cisco's 2024 Data Privacy Benchmark Study, 92% of organizations acknowledge they need to do more to reassure customers about how their data is used with AI (Source: Cisco Data Privacy Benchmark Study, 2024).

Here is what you need to understand.

Most AI tools process data on external servers. When you use a cloud-based AI platform, your data typically leaves your network and is processed on the provider's infrastructure. This is standard and not inherently dangerous, but it means you need to understand the provider's data handling policies. Does the provider store your inputs? Do they use your data to train their models? Can their employees access your information? These are not hypothetical concerns. Different providers have very different answers.

Free tiers and paid tiers often have different privacy rules. Many AI providers use data from free-tier users to train and improve their models. Paid plans frequently offer stronger privacy protections, including commitments not to use your data for training. If you are using a free version of an AI tool for business purposes, read the terms of service carefully. You may be giving away more than you realize.

Industry-specific regulations still apply. If your business handles healthcare data (HIPAA), financial data (SOX, PCI-DSS), or data from European customers (GDPR), those regulations do not pause because you are using AI. You are still responsible for how that data is handled, stored, and processed. Using an AI tool that is not compliant with your industry's regulations exposes you to legal and financial risk.

Your team is the weakest link. Even with the right tools and the right policies, data privacy breaks down when employees use AI tools without understanding the rules. Copying client data into a personal ChatGPT account. Uploading confidential documents to an unapproved platform. Sharing proprietary information in prompts that may be stored or reviewed. These are not edge cases. They happen every day in businesses that have not established clear AI usage guidelines.

What you should do about it. First, inventory every AI tool your business uses, including the ones employees signed up for on their own. Second, read the data handling policies for each one. Specifically look for: data storage practices, training data usage, employee access controls, and compliance certifications. Third, establish clear internal guidelines about what data can and cannot be shared with AI tools. Fourth, ensure your paid plans include the privacy protections your business requires.

Consider where your data is processed geographically. Data residency matters for regulatory compliance. Some AI providers process data in multiple countries, which can create complications under data protection laws like GDPR. If your business operates across borders or serves international customers, verify that your AI tools comply with the data residency requirements that apply to you.

Data privacy in AI is not about being paranoid. It is about being informed. The tools are powerful and often worth using. But using them responsibly requires understanding what you are agreeing to and making sure it aligns with your obligations to your customers, your employees, and your business.
